As a member of our Buildings group, you will provide insight and innovative solutions to ensure the successful delivery of various projects, such as: education facilities; hospitals and healthcare centres; office buildings; warehouse and distribution centres; retail outlets and complexes; recreational facilities; hotels and casinos; parkades; and mixed- use facilities. You will also further hone your skills operating under various delivery methods including Bid-Build, Design-Build, P3 (Public-Private Partnership), Construction Management and IPD (Integrated Project Delivery).

About the Role

Reporting functionally to the Commercial Director and operationally to the applicable Business Unit management team, the Senior Commercial Manager is accountable for providing contractual, financial, and risk management support to pre-construction and project teams, as well as commercial assistance to senior operations management.

Key functions include providing timely and accurate advice on a wide range of commercial matters, liaising with Graham’s internal Legal and Risk groups, working with third party experts and counsel and managing and mentoring other commercial managers, project commercial managers, commercial coordinators, and project team personnel.

Key responsibilities include:

Commercial Management

  • Review RFQ / RFP or bid / tender documentation and provide advice to pre-construction teams.
  • Conduct Prime Contract reviews to identify contract and commercial risks / opportunities.
  • Ensure RFQ / RFP or bid / tender documentation submissions are compliant, risks are properly identified and addressed within the submissions.
  • Assist in the preparation of standard, bespoke and/or modified Consultant and Subtrade Agreements, Joint Venture Agreements, MOUs and Prime Contracts.
  • Provide advice on performance security and insurance.
  • Ensure that the project team understands the deliverables and obligations of the Prime Contract Work with project teams and operational management to develop procurement plans and strategies.
  • Ensure that a formal risk-management process is implemented on every project, including identifying and documenting mitigation plans.
  • Monitor risk management activities throughout the project lifecycle.
  • Manage the project’s commercial administration and mentor and support the project team to ensure contractual compliance.
  • Support the project team in developing subcontract scopes of work, evaluation of submissions and negotiations.
  • Assist with the preparation, negotiation, and approval change order requests.
  • Develop and deliver regular reporting updates to management on all commercial elements, project financials and forecasts.
  • Support the preparation of claims, including defining contractual entitlement and ensure that the required level of substantiation and quantification is provided.
  • Work with Legal and Risk to support the defense of claims including engaging and directing third-party experts.
  • Support the project team with contract close-out to achieve formal project acceptance.
  • Support the project team with respect to warranty obligations and monitoring of warranty compliance.
  • Ensure compliance with established commercial policies and procedures, including delivering training and mentoring to the project team and other Commercial Managers.

Planning and Process

  • Participate in the development of Best Practice tools and procedures that align with the Graham Management System
  • Ensure that commercial best-practice processes and procedures are effectively implemented.

Financial Accountabilities

  • Oversee and report regularly to management on the Cash Management, Cost Control, Profit & Loss Reports, Forecasts, and Risk & Opportunity functions. Client Focus
  • Establish and maintain effective working relationships with public and private sector clients, joint-venture partners, financing partners, and key subcontractors and suppliers.
  • Work to ensure customer service is an integral part of the project.

Qualifications/Experience:

  • Degree in Construction Management, Engineering, Quantity Surveying, Business, or a related field.
  • 10-15 years of construction and/or related commercial management experience working on large complex construction projects.
  • Advanced knowledge of construction contract administration and the principles of purchasing, finance, and estimating.
  • Strong negotiation skills, including resolution of deficiencies and / or claims.
  • Thorough understanding of contract law and detailed experience working with various contract types and forms.
  • Commitment to quality and safety through evaluating project-related processes and meeting to exceed internal and external customer expectations.
  • Experience working within a P3 / Design-Build environment.
  • Ability to effectively influence and negotiate favorable outcomes.
  • Ability to draft and interpret legal language.
